Terms of Use

Terms in short
Pebble is where people recommend places they love to people they actually know. These terms are the rules that keep it that way. The short version:
- Recommend honestly. Only recommend places you genuinely would send a friend to. Never for money, discounts or favours, and never your own business.
- Be kind. Pebble is positive only. Don't use it to criticise, harass or expose anyone.
- Your content stays yours. You give Pebble permission to show it to the people you share it with, and nothing more. That permission ends when you delete it.
- No one can buy their way up. Venues can't pay for placement, ratings or recommendations.
- Pebble is free for people. Venues can pay for Pebble for Business, under the extra terms in section 7.
- Your rights as a consumer stay intact. Nothing in these terms takes away rights you have under the law where you live.
Please read the full terms below. They form an agreement between you and Maarten Kaufmann, who develops and runs Pebble.
1. About these terms
These terms apply when you use Pebble: the iOS and Android apps, the website at pebble.guide, shared lists, request links, venue QR codes and Pebble for Business. "Pebble", "we" and "us" mean Maarten Kaufmann, a private individual based in Denmark (Vesterhavsgade 15, 7700 Nørre Vorupør), who develops and runs Pebble. If Pebble becomes a company, that company will take over this agreement, and we'll tell you before that happens.
By creating an account or using Pebble, you agree to these terms and to our Privacy Policy, which explains how we handle your personal data. If you don't agree, please don't use Pebble.
Who can use Pebble. You must be at least 16 years old. Pebble is available across Europe: the EU and EEA, the United Kingdom and Switzerland.
If you use Pebble for a business, such as a venue on Pebble for Business, you confirm that you are allowed to act for that business, and these terms bind the business too.
2. Your account
- Your real name. Pebble works because people know who a recommendation comes from. Use your own first and last name and, if you add one, a photo of yourself. Don't pretend to be someone else.
- One account per person. Accounts are personal. Don't share yours, sell it or create extra accounts.
- Keep it safe. Keep your password and sign-in emails to yourself. Tell us at privacy@pebble.guide if you think someone else has used your account.
- You're responsible for what happens in your account, unless it was used without your permission and you couldn't have prevented it.
- You can delete your account at any time under Profile → Account → Delete account. What happens to your data is described in the Privacy Policy.
3. Community rules
Every recommendation on Pebble should be one a real person would happily make to a friend over dinner. To keep it that way:
Recommendations must be genuine.
- Only recommend places you've been to and would truly send a friend to. Saving a place you want to try is fine.
- Never recommend a place in exchange for money, free food or drinks, discounts or any other benefit, and never ask or offer anyone else to do so.
- Don't recommend a business you own, work for or are paid by, or ask staff, family or friends to recommend it for you. Don't recommend or remove recommendations to harm a competitor.
- Don't use several accounts, bots or coordinated groups to make a place look more recommended than it is.
Pebble is positive only. Notes are for saying why a place is worth going to. Don't use them to criticise a place, its staff or other people.
Respect other people. Don't post content that:
- harasses, threatens, bullies or discriminates against anyone;
- shares someone else's personal information, such as a staff member's full name, phone number or photo, without their permission;
- is sexual, violent, hateful or otherwise unlawful;
- infringes someone else's copyright or other rights, for example a photo you didn't take.
Respect Pebble. Don't:
- copy, scrape or collect content or data from Pebble with bots or other automated means;
- try to get around rate limits, security measures or blocks;
- send spam, advertising or chain messages through requests, lists or links;
- reverse-engineer the apps, or interfere with how Pebble works.
If you break these rules we may remove content or limit or close your account, as described in sections 6 and 9.
4. Your content
You own what you create. Your recommendations, notes, lists, requests, tips and photos ("your content") remain yours.
The permission you give us. So that Pebble can work, you give us a non-exclusive, royalty-free permission, valid worldwide, to store, copy, display and adapt your content (for example, resize a photo or shorten a note in a preview). We use it only to:
- show your content to the people you share it with, through the app, the website, shared links and requests;
- show public notes about a venue, and recommendation counts, to that venue on Pebble for Business (section 7);
- run, protect and improve Pebble.
We won't sell your content, and we won't use your name, photo or notes in advertising for Pebble without asking you first.
When the permission ends. It ends when you delete the content or your account. Copies may remain for a short time in backups, and content already in someone else's hands, such as a friend's own saved copy of a place you tipped them, stays theirs.
Your promise to us. You confirm that you have the right to post your content, and that it follows these terms and the law.
Feedback. If you send us ideas or suggestions, we may use them freely, without paying you.
5. Guests, shared links and QR codes
Answering without an account. You can send tips to a friend's request through a link without signing up. When you do, these terms apply to what you send. Use your own name, not someone else's. Your tips are shown only to the person who asked, until you confirm your email.
Sharing links. Anyone with a link to your list or request can see it, even without a Pebble account. Only share links with people you want to see them. You can stop sharing a list at any time.
QR codes at venues. Venues may display a Pebble QR code inviting guests to recommend them. Recommending is always your choice. A venue may not offer you anything in return for recommending it (section 3).
6. Reporting, moderation and appeals
We don't check content before it appears on Pebble, but we act on what we find or what's reported to us.
Reporting content. If you see something on Pebble that is illegal or breaks these terms, email privacy@pebble.guide. Tell us where the content is, why you think it's a problem and, if you can, your name and email so we can reply. We handle reports carefully and without undue delay, and tell you what we decided.
What we may do. If content breaks the law or these terms, we may remove it, hide it from some people, or limit, suspend or close the account behind it. We choose the lightest step that solves the problem, taking into account how serious it is, whether it happened before and whether it was deliberate.
We'll tell you why. If we remove your content or restrict your account, we'll tell you what we did and why, including the rule or law involved, unless the law or safety reasons stop us.
Appeals. If you disagree with a decision, reply to our message or email privacy@pebble.guide within six months. A person will review it, and we'll reverse it if we got it wrong. You can also use an out-of-court dispute settlement body certified under the EU Digital Services Act, or go to court.
Repeated false reports. If someone keeps sending clearly unfounded reports, we may stop handling their reports for a reasonable time, after warning them.
Contact point. Authorities and users can reach us about these matters at privacy@pebble.guide, in English or Danish.
7. Venues and Pebble for Business
This section applies to venues that claim a profile or subscribe to Pebble for Business, in addition to the rest of these terms.
What a venue gets. Every venue can claim its profile for free. The Business plan adds more tools for understanding and showing recommendations, as described below and on pebble.guide/business.
What a venue can't do. Payment never changes recommendations, rankings or what people see. A venue may not:
- offer guests or staff anything in return for recommending it, including discounts, free items or prize draws;
- recommend itself or ask staff, owners or their families to do so;
- ask people to remove a recommendation, or contact recommenders outside Pebble using information from Pebble;
- present its Pebble count misleadingly, for example by editing the widget or QR material.
Accurate details. Keep your venue's name, address, opening hours and contact details correct. Only claim a venue you are allowed to represent; we may ask for proof.
Plans and payment.
- Free: claim your venue's profile, edit its name, address, website and photo, and get your own venue page and QR code.
- Business: DKK 59 per month, excluding VAT, billed monthly in advance. VAT is added where the law requires it. Adds a promotion package (window sticker and counter card), a social proof widget for your website, and analytics about your recommendations. Promotions may never be conditional on recommending the venue (see above). Cancel at any time; the plan runs until the end of the paid month, with no refund for the part already started.
We may change prices with at least 30 days' notice; you can cancel before the new price applies. If a payment fails, we may pause the paid features until it's paid.
Business customers. Pebble for Business is for businesses, so consumer rights of withdrawal don't apply to it. We may end a venue's access if it breaks these terms, after a warning where reasonable; if we end it without such a reason, we refund the unused part of a monthly plan.
8. Pebble's content, place data and other services
Pebble belongs to us. The Pebble name, logo, apps, website and design are ours. We give you a personal, non-transferable right to use Pebble under these terms. You may not use our name or logo in a way that suggests we endorse you.
Place information. Place names, addresses, photos, opening hours and categories come partly from other services, such as Google, and partly from users. We do our best, but we can't guarantee it's correct or up to date. Check before you go.
Recommendations are opinions. Recommendations and notes are the personal views of the people who write them, not ours. We don't endorse any venue, and your visit is between you and the venue.
Other services. Pebble links to other apps and websites, such as maps, booking pages or a venue's own site. They have their own terms, and we're not responsible for them.
9. Changes to Pebble, suspension and ending your account
Pebble will change. We regularly add, change and remove features. If a change takes away something important you rely on, we'll tell you in advance where we reasonably can.
You can leave at any time by deleting your account. Venues can cancel Pebble for Business as described in section 7.
When we may suspend or close an account. We may limit, suspend or close your account if you seriously or repeatedly break these terms or the law, if it's needed to protect other people or Pebble, or if the law requires it. Where we reasonably can, we'll warn you first and give you a chance to put things right. We'll always tell you why (section 6), and you can appeal.
If Pebble closes. If we decide to stop running Pebble, we'll give you at least 30 days' notice and a way to download your recommendations and lists. Business subscribers will be told at the same time and refunded for any paid period they can no longer use.
Sections 4 (on content already shared), 8, 10 and 11 continue to apply after this agreement ends.
10. Responsibility and liability
How Pebble is provided. Pebble is a free service for people, built and run with care, but we can't promise it will always be available, error-free or that every place will live up to a recommendation. This doesn't limit your statutory rights, including your rights if Pebble doesn't work as described.
For consumers. We are responsible for losses you suffer that are a foreseeable result of our breaking these terms or failing to use reasonable care. We are not responsible for losses that were not foreseeable, for losses caused by other users or venues, or for anything outside our reasonable control.
For businesses. For Pebble for Business, our total liability in any 12-month period is limited to the amount the venue paid us in that period. We are not liable for lost profits, revenue or business opportunities.
What we never limit. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, for intent or gross negligence, or any other liability that the law doesn't allow us to limit.
Your responsibility. If you break these terms or the law, and someone makes a claim against us because of it, you are responsible for the reasonable costs that follow, to the extent the law allows.
11. Changes to these terms, law and disputes
Changes. We may update these terms when Pebble or the law changes. For important changes we'll tell you in the app or by email at least 30 days before they apply. If you don't agree, you can delete your account before then. Small changes, such as fixing typos, apply when we publish them.
Which law applies. These terms are governed by Danish law. If you're a consumer living elsewhere in Europe, you also keep the protection of the mandatory consumer laws of your home country.
Solving problems. Please contact us first at privacy@pebble.guide; most issues can be fixed quickly. If that doesn't work:
- consumers can bring a claim in the courts of Denmark or of the country where they live;
- businesses agree that disputes go to the Danish courts, with the Copenhagen City Court (Københavns Byret) as the first instance;
- for decisions about content or accounts, the options in section 6 also apply.
Other legal bits. If part of these terms turns out to be invalid, the rest still applies. If we don't enforce a rule straight away, we can still do so later. We may transfer this agreement to a company that takes over Pebble (section 1); your rights won't be reduced by it. We may offer translations; if a translation differs, the English version applies, unless the law where you live says otherwise.
